Abstract

The article is devoted to the definition of the basic scientific and theoretical approaches to understanding the concept of "limitation in the activities of law enforcement agencies", which are presented in modern legal science. Theoreticians of law have found the organic relationship between such legal categories as incentives and restric tions, which were considered to be paired. Significantly expanded view of the correlation of concepts such as "prohibition" and "restriction". Although today among the theorists of law there is no unity in the question which of them is "generic", but which is "species-specific". However, the restrictions on the activity of the law-enforcement bodies themselves, investigated, especially in the domestic theoretical and legal science, are still insufficient, especially in light of recent changes in Ukrainian legislation (the Law on "Preventing Corruption", the Law "On Conducting Operative-Investigative Acts ", Law on" On the National Police of Ukraine ", etc.). As a rule, addressing this problem occurs in the context of relat ed problems of exceeding the limits of official authority and administrative discretion. However, this problem, of course, has many more aspects that require proper theoretical understanding. Moreover, carrying out further investigations of a legal remedy, a "legal constraint", can objectively contribute to the improvement of many laws and regulations, streamlining of legal techniques, and also to find practical application in the activities of state bodies, including those forming the domestic law-enforcement system.
