OBJECTIVE SIDE OF THE CRIME, TO PUNISH SERVICE ABUSE: SOME ASPECTS

Abstract
Work is devoted to the some aspects ofobjective side of asuch crimes as: authority, office and service position abuse (Art. 364, 364-1, 365-2 Criminal code of Ukraine). The state of research of a given topic is analyzed in scientific literature. The definitions of authority, office and service position and the interests of the serviceisstudied. These and other terms, used by the legislator in this area are compared. Author came to the conclusion that authority of official is not a feature which one should use during criminal law qualification.
