Переважне право на залишення на роботі при вивільненні працівників / Preemptive Right to Keep the Position during Dismissal

Abstract

The article deals with theoretical and practical issues of a preemptive right to keep the position during dismissal. Criteria and procedure of identifying employees with a higher qualification and labour productivity have been researched into. Particularly, special attention has been drawn to the national case law on labour disputes when the courts interpret some criteria and proves of higher or lower qualification and labour productivity at dismissed employees. Such proves can be documents and other information on education and other qualification categories, advanced training, training at working place as well as information on inventions and sustainable proposals, temporary fulfillment of duties of employees with higher qualification, working experience, labour productivity etc. The list of persons who have an advantage to keep their positions in the event of equal conditions of labour productivity and qualifications has been analyzed. Following the research proposals on improvement of effective labour legislation have been made.
