PERFORMING JUDICIAL EXPERTISE ON THE REQUESTED ROGATORY COMMISSION

Abstract
In case of solving criminal cases, situations may arise where, in order to solve the criminal case, certain evidence and means of proof are required, which can only be obtained by applying the special knowledge of the experts from abroad. The procedural institution through which the procedural acts necessary for solving the criminal case are obtained abroad is the rogatory commission. The international rogatory commission involves a shift of territorial jurisdiction from one judicial body to another. In all cases, the rogatory commission shall be drawn up by the prosecutor responsible for the prosecution or by the court examining the case. In the case of the provision of the judicial expertise at the request of the rogatory commission, other procedural acts are also attached, whereby the judicial expertise is disposed. Request for rogatory commission is transmitted through the General Prosecutor’s Office or the Ministry of Justice.
