REFORM OF THE NOTARY IN THE RUSSIAN EMPIRE IN 1866

Abstract
The paper deals with the main changes that took place at the Notary Institute in 1866. The basic ideas, role and place of the Statute on the notarial part (April 14, 1866) in the Russian Empire were determined. The author indicates the sphere of activity, the main rights and duties of notaries. The main purpose of the activities of notaries is determined: the implementation of any type of acts and certificates relating to the competence of notaries; registration of all acts of real estate and their transfer to a notarial archive at the District Courts; development of private credit, which has to be provided with real estate. The requirements that were set before the candidates at the notary’s place were determined. Each notary must be in the citizenship of the Russian Empire, reach the age of majority (21), not be under investigation, and not be in the state or public service and to be aware of the legislation required for the performance of notarial activities. The reform of the notary in 1866 had its drawbacks and some inaccuracies. And before the adoption of the Statute there was the chaos in the sphere of notarial activity. But nevertheless, in the second half of the nineteenth century, in all the provinces of the Russian Empire notaries who were authorized by the state to perform notarial acts and managed to resolve that chaos have operated.
