РИЗИК В АЛЕАТОРНИХ ТА МІНОВИХ ДОГОВОРАХ

Abstract
The article is devoted to the problems of determining the place of risk in the aleatory and barter contractual constructions. The peculiarities of aleatory and barter contracts are analyzed. The conclusion is made that the fission of aleatory and barter contracts is conditioned by the dependence of the counter offer and its size from a future random event. In the aleatory contract, the risk acts as a legal element, condition of the contract. For a barter contract, the risk is the result of already existing contractual relations.
