SOME ISSUES REGARDING PROTECTION OF THE ECONOMIC ENTITIES IN UKRAINE AGAINST UNFAIR COMPETITION IN THE COURSE OF FOREIGN ECONOMIC ACTIVITY

Abstract
The author covers in the article the essence of administrative and legal protection of economic entities in Ukraine against unfair competition in the course of foreign economic activity. According to the author, the essence of administrative and legal protection against unfair competition in the course of foreign economic activity involves application of the respecting actions and measures against foreign economic entities, in particular, exertion of the state influence of Ukraine on the conditions of foreign economic activity performed by the foreign economic entities and application of antidumping, compensatory, special and other measures against foreign economic entities by Ukraine represented by its state regulation bodies in the field of foreign economic activity. The author also defines the methods of administrative and legal protection against unfair competition in the course of foreign economic activity, in particular the introduction of licensing regime and allocation of quotas for foreign economic operations; taking measures in response to discriminatory and/or unfriendly measures of other states; prohibition of certain types of export and import; application of sanctions for violation of the rules of foreign economic activity: application of anti-dumping measures, application of compensatory measures, application of special measures, imposition of penalties, etc. The research paper article also offers the definition of the category of «administrative and legal protection in the field of economic competition in the course of foreign economic activity » in the administrative law science. It is suggested to treat the administrative and legal protection in the field of economic competition in the course of foreign economic activity as administrative and procedural activity of the state regulatory bodies in the field of foreign economic activity regarding the implementation of administrative actions, taking legal protection measures against foreign economic entities aimed at restoring violated rights and legitimate interests of economic entities in Ukraine, termination of violations in the customs territory of Ukraine, rectification of the unfair trade practice in Ukraine and elimination of monopoly in the field of foreign economic activity.
