INFORMATION ADMINISTRATOR AS A SUBJECT OF ENFORCEMENT OF THE HUMAN RIGHT TO PUBLIC INFORMATION

Abstract
The paper analyses the provisions of the Law “On Access to Public Information” concerning the content and types of the administrator of public information. The author clarifies the content of the information administrator as a subject of enforcement of the human right to public information, studies empirical documents which confirm existing gaps in the sphere as well as defines promising directions for further researches on the subject. It is stated that the provisions of the Law “On Access to Public Information” have significant challenges during the implementation because the process of identifying subjects, which have the characteristics of the information administrator, is sometimes original and followed by an interpretation of the norms of a large number of regulatory legal acts which consolidate the status of state administration bodies, local self-government bodies and other subjects. It is substantiated that the information administrators should be associated exclusively with legal bodies which, first, are public officers; second, financed by the state, local budgets, the budget of the Autonomous Republic of Crimea; third, exercise delegated powers of public officers in accordance with a law or a contract, including the provision of educational, recreational, social or other public services; the fourth, undertakings which dominate at the market or are empowered with special or exclusive rights or are natural monopolies in Ukraine.
