শরীয়া মাকাসিদের তাত্ত্বিক বিকাশ: একটি ঐতিহাসিক বিশ্লেষণ|The Theorization of Maqasid al-Shari’ah : A Historical Analysis

Abstract
Some Muslim scholars negate the underlying purposes (Maqāsid) cemented by reason behind a ruling under Islamic Law. On the other hand, some orientalists propose some yet temporal benefits as maqāsid that are alien to the sources of Islamic law and not linked to the ultimate success in the Hereafter. Hence, it is necessary to study the theorization of maqāsid al-sharīÕah to determine its originality. This paper in employing a historiographic method aims to discuss the theorization of maqāsid al-sharīÕah from its inception until theorization. The paper reveals that although the concept of maqāsid al-sharīÕah was not established as a theory since its inception, the holy Qur’an and the Sunnah emphasize it enough through their rulings (ahkaām). Hence, down through the generations, the Muslim jurists had been found to appliy this concept in their ijtihād while extracting rulings. Maqāsid al-sharīÕah started to be systematically theorized by Imam al-Juwaynī and followed by his disciple Imam al-Ghazalī. Afterwards, it was crystallized by Imam al-Shatibi and proclaimed as a new branch of knowledge by Ibn ÔĀshur. The paper also reveals that maqāsid al-sharīÕah ensure human welfare by achieving all possible benefits and avoiding all harms so as to prove Islamic law so dynamic and applicable over time and space কিছু সংখ্যক মুসলিম স্কলার ইসলামী আইনের অন্তর্নিহিত কারণকে অস্বীকার করেন। অপরদিকে কিছু সংখ্যক প্রাচ্যবিদ কুরআন ও সুন্নাহ বহির্ভুত কিছু উদ্দেশ্যকে শরীয়ার মাকাসিদ হিসেবে প্রস্তাব করেন, যা মানুষের আখিরাতমুখী প্রকৃত কল্যাণ সাধন করতে সক্ষম নয়। তাই মাকাসিদ আশ-শারীয়ার মৌলিকতা নিরূপণ করতে এর তত্ত্বগত ধারণার উদ¢ব ও বিকাশ সম্পর্কে সম্যক অবগত হওয়া অতীব জরুরী। এই প্রেক্ষাপটেই অত্র প্রবন্ধের উদ্দেশ্য হচ্ছে, মাকাসিদ আশ্-শারীয়াহর সূচনা, ক্রমবিকাশসহ এর তাত্ত্বিক উন্নয়নের পর্যালোচনা করা। প্রবন্ধটি রচনার ক্ষেত্রে ঐতিহাসিক বিশ্লেষণ পদ্ধতির আশ্রয় নেয়া হয়েছে। বক্ষ্যমাণ গবেষণা থেকে প্রমাণিত হয়েছে, ইসলামী আইন দর্শনের সূচনা থেকে শরীয়া মাকাসিদ একটি তত্ত্ব (থিওরি) হিসেবে প্রতিষ্ঠিত না থাকলেও মহাগ্রন্থ আল-কুরআন এবং রাসূলুল্লাহর স. সুন্নাহতে এটিকে যথেষ্ট গুরুত্ব দেয়া হয়েছে। তাই সাহাবা কিরামসহ পরবর্তী ইসলামী আইন বিশেষজ্ঞ- ফকীহগণ মাকাসিদ আশ্-শারীয়াহ তত্ত্বকে প্রয়োগ করেই ইজতিহাদ করেছেন এবং মানবজীবনের প্রায় সকল ক্ষেত্রে অজস্র ইসলামী বিধান উদঘাটন করেছেন। হিজরী পঞ্চম শতাব্দীর শেষাংশে মাকাসিদ আশ্-শারীয়াহর তত্ত্বগত ধারণার উদ¢ব ঘটে এবং হিজরী অষ্টম শতাব্দীতে এ ধারণাটি একটি পূর্ণাঙ্গ তত্ত্বীয় রূপ লাভ করে। অতঃপর হিজরী দ্বাদশ শতাব্দীতে এটি জ্ঞানের একটি স্বতন্ত্র শাখা হিসেবে প্রস্তাবিত হয়। শরীয়া মাকাসিদের মাধ্যমে মানব জীবনের সকল ক্ষেত্রে প্রকৃত কল্যাণ ও সফলতা অর্জনের নির্দেশনা পাওয়া সম্ভব এবং এটিই ইসলামী শরীয়ার প্রাঞ্জলতা ও গতিশীলতার প্রমাণ।
