Abstract
The article describes typical FIDIC contracts. They detail the responsibilities of contractors and use the multi-stage system of obligations fulfillment. It has been revealed that some ways of ensuring the fulfillment of obligations included in standards are not stipulated in the current legislation of Ukraine. It has been found out that the introduction of FIDIC proforms in the construction market of Ukraine remains relevant. FIDIC contracts are balanced – the responsibility for the risk lies with the party that has the responsibility to control the risk and make the appropriate decisions. The use of standard FIDIC contracts allows flexible formulation of the agreement terms and does not oblige to impose excessively strict, disadvantageous rules for the parties, giving the parties the right to change certain provisions of the model contracts at their discretion. When concluding a contract the parties must be guided by the imperative provisions of Ukrainian legislation, which contains a number of similar rules. The positive and negative aspects of using FIDIC contracts in Ukraine have been highlighted. It has been concluded that there is an urgent need to adapt FIDIC standards.
