The current issues of labor and legal liability of the head of enterprises, institutions and organizations

Abstract
The article deals with the issue of bringing heads of enterprises, institutions and organizations to labor liability. The essence and significance of disciplinary liability in labor law has been disclosed. Also the article singled out the problems on efficiency mechanisms of disciplinary liability of heads. The author grounded the dual nature of the legal status of head in the employment relationship. The article advocated the idea to apply the principle of “unity and differentiation” in terms of bringing the head to labor and legal responsibility. The paper also contains proposals to improve existing labor laws and amendments to the draft Labour Code of Ukraine.
