THE NOTION OF "RIGHT" AND "LAW" IN THE PHILOSOPHICAL AND LEGAL THOUGHT OF THE EUROPEAN MIDDLE AGES

Abstract
The article is dedicated to the problem of the basic legal terms usage in Middle Ages. Genesis of medieval legal consciousness is described in this context. Fundamental difference of modern and medieval understanding of terms “law” (ius) and “legal act” (lex) is marked. Particular attention is paid to the study of the main approaches to the differentiation of these concepts that existed in medieval science. Defining characteristic of the legal thinking of the study period, which led to the specifics of the legal usage.
