THE PRESENCE OF GUILT AS A TORT LIABILITY IN THE CIVIL LAW OF UKRAINE AND THE USA

Abstract
The article is devoted to studying of such condition of a tort liability as presence of fault in civil law of Ukraine and the USA. It is paid attention that the tort liability in Ukraine is able to come both with fault of the offender, and in the absence of the last (in the cases established by the law). It is done the conclusion that in the civil law of the USA both cases as a tort liability for fault, and liability without fault or strict liability are known. The last concept covers cases when the law establishes responsibility, without demanding existence of any form of fault.
