Abstract
The article investigates the question mens rea under Art. 239-2 of the Criminal Code of Ukraine, the illegal occupation of lands of water fund a large scale. Deals with general criminal legal position regarding the understanding of the subjective side of a criminal assault, including under Art. 239-2 of the Criminal Code of Ukraine. The analysis of some international instruments aimed at preventing the commission of environmental crimes. Is substantiated dependence subjective side of crime against the environment, including misappropriation of lands of water fund and the level of legal awareness of each person.
