CONCERNING INDIVIDUAL ISSUES OF QUALIFICATION OF PREMEDITATED MURDER, COMMITTED BY AN ORGANIZED GROUP OR MEMBERS OF CRIMINAL ORGANIZATION

Abstract
This article is devoted to coverage of individual issues of qualification of premeditated murder, which is committed by an organized group or by members of criminal organization. The constitution of administrative ordinance of the Supreme Court of Ukraine № 2 from 07.02.2003 concerning a possibility of qualification on such qualifying basis as a committing a crime by group of persons with prior agreement in case committing premeditated murder by an organized group or members of criminal organization is critically estimated. It is stated, that it’s necessary to solve questions of foresight as qualifying features of constituent elements of offence of particular form of abetting and their correlation.
