Judicial discussions in the abbreviated procedure
Journal Title: Revista Institutului Național al Justiției - Year 2019, Vol 48, Issue 1
Abstract
Judicial debates are the stage in which the principles specific to the judgment (advertising, oral, and contradictory) are manifested in their fullness, confronting directly and directly the fundamental procedural functions: defense, prosecution and jurisdiction. Thus, in the course of the debates, the prosecutor and the parties present to the legally constituted court the views of the accusation and defense on the substance of the criminal case, and then give the court the opportunity to observe the truth and the solution to be given in the arguments. Thus, judicial proceedings, both in the joint proceedings and in the abridged procedure, constitute a procedural activity specific to the court, consisting of making exposures, formulating conclusions, both oral and contradictory, before the court, by the prosecutor and the other parties, or their representatives or defenders, of the subject matter of the judgment.
