Legal principles of forming and realization of military politics of Ukraine

Abstract

The purpose of the article is to analyze legal acts concerning the formation and implementation of Ukraine's military policy, as well as elaboration of proposals for solving problems that exist in the field of security and defense of Ukraine in view of the current geopolitical situation. Scientific novelty. Issues concerning the legal security of Ukraine's state security are investigated. The basic normative legal acts regulating the state policy in the field of military security are analyzed. The position is argued that the formation and implementation of the military policy of Ukraine is closely linked to social legal relations and is an important element of the legal system while ensuring the national interests of the state. The system of ensuring the national security of Ukraine is described as a complex state-legal mechanism, in which all subjects of legal relations carry out tasks and perform functions for the protection of vital interests of a person, a citizen, and the state within the limits of the powers determined by the national legislation. Conclusions. Normative-legal regulation of relations in the field of military policy of Ukraine is wide and multidirectional, which, in its turn, requires a lot of efforts in the development of projects and improvement of existing normative legal acts of Ukraine that ensure the proper functioning of the security and defense sector. According to the results of the analysis, we consider it necessary to make suggestions as to the appropriateness of adopting amendments and additions to the Laws of Ukraine «On State Guarantees of Social Protection of Servicemen Released from the Service in Relation to the Reform of the Armed Forces of Ukraine and their Family Members», «On the Armed Forces Ukraine», the Strategic Military Security of Ukraine and other normative legal acts. Adoption of amendments and additions to the normative and legal acts in the field of security and defense would confirm the activation of state policy and give impetus to further reform of the defense sector.
