Abstract
The theoretical and practical issues of determining size of rent on the agreement of lease of land plots in public and municipal property are investigated in the article. Rent, its size, indexation, method and terms of calculations, terms, procedure for its bringing and revision, responsibility for non-payment is a substantial condition of agreement of lease of land plots in public and municipal property. Rent for land plots in public and municipal property is a form of paying for a lot land, obligatory, fixed payment, what leaseholder provides to the lessor for using land plots in public and municipal property under the agreement of lease of land plots. The maximum sizes of rent for of land plots of public or municipal property are set by tax law and is obligatory to be taken into account during the enterance into corresponding agreements. Determining size of rent it is closely constrained with the normative money estimation of a lot land. Modern judicial practice sticks to a position that a change of normative money estimation of land plots is founding for the change of size of rent. Such approach conflicts with the Constitution of Ukraine. On the size of rent annual indexation influences straight. For the settlement of relations from establishment and non-payment of rent for land plots of public and municipal property voluntarily and imperative methods are used.
