Abstract
The article is devoted to the analysis of foreign experience in the application of preventive measures in the criminal process. It was emphasized the importance of the effective application of precautionary measures to ensure the fulfillment of the tasks of criminal proceedings, namely the protection of individuals, society and state from criminal offenses, the protection of the rights, freedoms and legitimate interests of participants in criminal proceedings, as well as the provision of a speedy, complete and impartial investigation and judicial review with a view to , so that anyone who has committed a criminal offense has been brought to justice in the guise of his guilt, no one was guilty of an innocent person or guilty. No particular attention is paid to using such a preventive measure as a domestic arrest. Home arrest ensures that individuals comply with their procedural obligations without pre-trial detention, which, in their turn, will prevent the unlawful detention of a person. The use of precautionary measures that are not related to detention allows saving state funds for the detention of persons in places of pre-trial detention, does not create situations where persons who were first brought to criminal liability contact with persons who had previously been held criminally experience It is preposterous that the practice of applying preventive measures in foreign countries is not the same, but at the same time it is possible to distinguish several main tendencies (we are talking primarily about countries with a developed legal system): constant improvement procedures, widespread use of technical means, the desire to achieve a balance between protecting the interests of society and the rights and freedoms of individuals. Problematic issues that arise during this activity, and possible ways of their solution are considered. The practical importance of the necessity of solving these problematic issues is emphasized.
