Problems of criminal liability for cruelty to animals

Abstract
The author has considered matters of solving the problem of criminal liability for cruelty to animals. Investigated the legislation with regards to animals. In analyzing the criminal liability by article 299 of Criminal Code of Ukraine. Today, the legal framework to counter cruelty to animals in Ukraine include a significant number of laws and other by-law regulatory act, but they don’t work efficiently. Investigated the possibility of recognizing international instruments on the protection of animal rights. The author has formulated conclusions and proposals aimed at of improving the criminal liability for cruelty to animals. The emphasis is placed for the improve mechanisms for responding police and other authorized entities to the facts of cruelty to animals. Attention paid to the necessary for adaptation Ukrainian legislation in according to the Law of European Union with high standards of democratic and humanity. A positive effect can be achieved only by a unified approach to the understanding and application of the Law, and therefore requires the adoption of a relevant by-law regulatory act, which would establish unified mechanisms for combating cruelty to animals, taking into account international norms and domestic legislation.
