THEORETICAL AND LEGAL ASPECTS OF “LIGHT” DRUGS LEGALIZATION IN UKRAINE

Abstract

The article deals with the theoretical and legal aspects of “light” drugs legalization of in Ukraine. The authors investigates the international experience of Netherlands, Brazil, Argentina, and the Czech Republic on this issue. In particular, it it has been dtetrmined that the Czech Republic is the most liberal state in relatuin to free drugs policy in the country. The attention has been paid to the petition on the legalization of marijuana in Ukraine. The authors state that there is an administrative and criminal liability in our country in the field of drug trafficking. The compositions of crimes from the Criminal Code of Ukraine have been indicated by the authors. Positive and negative consequences of drugs using legalization for the future development of the Ukrainian nation and state have been analyzed. Among the positive sides the authers determined the following: 1) increase the budget of the country; 2) the possibility of more effective control over the quality of drugs; 3) reduction of state expenses on courts, special services, detention of prisoners; 4) the possibility to import drug-containing medicines. Also, the following negative consequences have been indicated: 1) the significant increase of drugs addicted through free and unpunishable access to drugs; 2) due to economic instability, state control can have just a formal character; 3) the shadow market of drug trafficking will take place even in the case of drugs legalization in conditions of proper control absence; 4) the problem of rehabilitation of drug addicted will be intensified; 5) the use of drugs in the state becomes accessible to minors. It has been concluded that nowadays the damage from “light” drugs legalization will significantly outweigh the possible benefits. Ukrainian society, given the economic, as well as moral and cultural decline, spiritual crisis, is not prepared to respond adequately to legalization of “light” drugs. The authors insist that in our time there should be no question of “light” drugs on the state level, but strengthening of preventive measures for the spread of drugs addiction in Ukraine.
